Terms of Service for FRESH ADVENTURE COMPANY

PLEASE READ THESE TERMS OF SERVICE CAREFULLY. BY MAKING A BOOKING WITH US, YOU ARE AGREEING TO BE BOUND BY THESE TERMS AND CONDITIONS.
This document constitutes a legally binding agreement (“Agreement”) between you (“the Renter,” “you,” “your”) and FRESH ADVENTURE TRANSPORT (“the Company,” “we,” “us,” “our”) governing your rental of a vehicle from us.
1. Renter’s Eligibility and Requirements
To rent a vehicle from us, the Renter must:
- Be between the ages of
[18 and 65]. - Possess a valid and current local Malaysian driving license (probationary ‘P’ licenses are not accepted) or a valid International Driving Permit for non-Malaysians.
- Provide a valid identity card (MyKad) or Passport for verification.
- Not be under the influence of alcohol or drugs at the time of rental.
Only the person(s) named in the Rental Agreement are permitted to drive the vehicle.
2. Booking, Payment, and Confirmation
Booking: Reservations can be made through our website www.freshadventure.com.my or via WhatsApp.
Confirmation: A booking is only confirmed upon receipt of a booking deposit. The remaining balance must be paid in full upon vehicle collection.
Payment Methods: We accept payment via online transfer, credit/debit card, or e-wallet.
Rates: Rental rates are quoted in Malaysian Ringgit (MYR). Rates include vehicle maintenance and standard comprehensive insurance but exclude fuel, parking fees, traffic fines, tolls, and delivery/collection charges where applicable.
3. Security Deposit
A refundable security deposit of [e.g., RM 200] (amount may vary by vehicle model) is required upon vehicle collection.
This deposit covers potential costs for damages, excessive cleaning, missing fuel, traffic summonses, or late returns.
The deposit will be refunded in full within [e.g., 7 to 14] working days after the vehicle is returned, provided there are no outstanding issues. Deductions will be made for any of the aforementioned costs.
4. Cancellation and Refund Policy
Early Bird Cancellation (2 weeks or more in advance): Full refund of the booking deposit.
Cancellation 3 days or more before pick-up date: 50% refund of the booking deposit.
Cancellation less than 3 days before pick-up date: The booking deposit is non-refundable.
No-Show: Failure to collect the vehicle on the scheduled date and time will be considered a “no-show,” and the booking deposit will be forfeited.
5. Vehicle Usage, Responsibilities, and Prohibitions
Renter’s Responsibility: The Renter is responsible for the vehicle’s condition from the time of pick-up until it is returned. This includes ensuring the vehicle is locked when unattended and taking care of the car keys.
Prohibitions: The vehicle shall NOT be used for:
- Any illegal purposes (e.g., committing crimes, transporting illegal substances).
- Racing, pace-making, or any form of competitive driving.
- Off-road driving on unpaved surfaces.
- Transporting animals, smoking, or carrying strong-smelling items (e.g., durian, salted fish).
- Sub-renting to any third party.
Driving Area: The vehicle is to be used within the [e.g., Kuching, Sarawak] area only. Driving beyond [e.g., the Serian district] or across national borders is strictly prohibited without prior written consent from us, and additional charges will apply.
Traffic Fines: The Renter is fully responsible for all traffic, parking, or other summonses incurred during the rental period.
6. Pick-up and Return of Vehicle
Vehicle Inspection: The Renter must inspect the vehicle for any existing damage upon collection and ensure it is recorded in the Vehicle Checklist form.
Fuel Policy: The vehicle must be returned with the same level of fuel as at the time of pick-up. A refueling charge will be imposed if the fuel level is lower.
Late Return: An extension of rental must be requested at least 24 hours in advance. If the vehicle is returned late without prior notice, a late penalty will be charged at an hourly rate. A return delay of more than [e.g., 5] hours will be charged as a full day’s rental.
Cleanliness: The vehicle should be returned in a reasonably clean condition. An extra cleaning fee will be charged for excessively dirty vehicles or for removing stains and odours.
7. Accidents, Damage, and Breakdown
Accident: In the event of an accident, the Renter must:
- Not admit liability.
- Immediately notify the Company.
- Make a police report within 24 hours.
- Obtain details of all other parties involved.
Breakdown: In case of a vehicle breakdown, please contact our support line immediately. We will arrange for roadside assistance or a replacement vehicle.
Renter’s Liability: The Renter is liable for the full cost of damages if the accident is due to their negligence or a breach of this Agreement. For other cases, the Renter’s liability is limited to the insurance excess amount.
8. Insurance
All our vehicles are covered by comprehensive insurance, which includes protection against theft, fire, and third-party liability.
The insurance does NOT cover:
- Damage due to negligence (e.g., driving under influence, driving on unpaved roads, wrong fuel type).
- Loss of personal belongings.
- Damage to tires, rims, or undercarriage.
The Renter is liable for an insurance excess of up to [e.g., RM 2,000] (amount varies by vehicle) in the event of any damage. This excess can be reduced by purchasing our optional Collision Damage Waiver (CDW).
9. Termination of Agreement
The Company reserves the right to terminate this Agreement and repossess the vehicle at any time at the Renter’s expense if the Renter is found to be in breach of any terms of this Agreement.
10. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of Malaysia.
11. Changes to Terms
We reserve the right to modify these Terms of Service at any time. Any changes will be posted on our website.
